Tribunal Roster of Public Members under the Health Professions Act

The Minister of Primary and Preventative Health Services is seeking applications from individuals interested in serving as a public member of the Tribunal Roster established under the Health Professions Act (HPA).
- The Tribunal Roster, established under section 13(1)(b) of the HPA, is a list of public members appointed by the Lieutenant Governor in Council that is used by health profession regulatory colleges (governed under the HPA) to select public members for complaint review committees or hearing tribunals.
- There are 29 health professional regulatory bodies, or colleges, responsible for regulating approximately 40 different health professions (e.g., chiropractors, dental assistants, registered nurses) under the HPA that require public members to sit on their hearing tribunals and complaint review committees.

This is an excellent opportunity for Albertans looking to raise their professional and personal profile by working alongside regulated health professionals to uphold accountability and, ethical and competency standards of health professionals. By providing an external perspective on complaint review committees and/or hearing tribunals, public members support health regulatory colleges in governing their profession in a way that protects and serves public interest.
As a public member on the Tribunal Roster you will be required to:
- Participate in reviewing appeals and attending hearings.
- review and hear written and oral evidence presented to the complaint review committee or hearing tribunal, and deliberate with other committee members, with respect to complaints made against regulated health professionals;
- in accordance with the HPA, analyze, assess and weigh the evidence presented against the regulated professions’ codes of ethics, standards of practice and relevant legislation to reach a fair and impartial decision;
- participate in the development of, and review, the written decision following the close of disciplinary proceedings; and
- bring an independent and objective perspective external to that of the regulated health profession to ensure views of the health system user, third parties and the public are considered in the decisions making process.
Public members are appointed for a term of up to three-years and may be eligible for reappointment for an additional term but may only serve a maximum of six consecutive years.
Public members appointed to the Tribunal Roster should possess the following:
- Effective communication skills;
- Analytical/critical thinking/problem solving skills;
- Leadership and collaboration skills;
- Ability to synthesize information;
- Regulatory and professional governance knowledge; and
- Ability to exercise objectivity, sound judgement and diligence.
Ideally, public members appointed to the Tribunal Roster should also possess two or more of the following:
- Professional, volunteer and/or non-profit experience
- Experience with:
- Quasi-judicial proceedings;
- Administrative tribunal or justice proceedings; and
- Interpreting and applying legislation.
- Basic understanding of Alberta’s health sector and Alberta’s regulated health professions.

Public members are appointed for a term of up to three-years and may be eligible for reappointment for an additional term but may only serve a maximum of six consecutive years.
- This is not a wage or salaried position.
- Public members appointed to the Tribunal Roster receive remuneration in accordance with Schedule 1, Part A of the Committee Remuneration Order (O.C. 466/2007), subject to review. The current rates that a public member may claim for attending meetings and hearings are:
- $164 for up to and including four hours in any day, or
- $290 for over four hours and up to and including eight hours in any day, or
- $427 for over eight hours in any day, spent on the business of the complaint review committee and/or hearing tribunal.
- They may also be reimbursed for reasonable living and traveling expenses necessarily incurred in the course of performing their duties as public members in accordance with the Public Service Relocation and Employment Expenses Regulation and the Government of Alberta’s Travel, Meal and Hospitality Expenses Policy.
- Time commitment is variable and subject to the volume of college complaint review committees and hearings.
- The length of hearings vary from part of a day to several consecutive days; however review committees and hearing tribunals may also meet in advance of the main proceeding.
- These proceedings often require significant preparation time, which is not currently eligible for remuneration.
- Complaint review committees and hearings maybe held virtually or may be held in person in locations across Alberta; however, most are held in Edmonton and Calgary, or virtually.
The following will NOT be considered for appointment as public members:
- a person who is a current regulated health professional ;
- a person who represents or is normally engaged in representing a group of employees who are regulated members in the negotiation of collective bargaining agreements or in any proceedings under a collective bargaining agreement with respect to regulated members or who negotiates or sets professional fees or guidelines on professional fees on or on behalf of regulated members of the college;
- a person who is an officer or senior employee of a professional association or a labour union that represents members of a regulated health profession;
- a member or officer of a provincial health agency or provincial health authority under the Provincial Health Agencies Act;
- an employee of the ministries of Primary and Preventative Health Services, Assisted Living and Social Services, Hospital and Surgical Health Services or Mental Health and Addiction; and
- individuals whose appointment would result in an actual or perceived conflict of interest.
