The Minister of Service Alberta and Red Tape Reduction is seeking applicants from individuals interested in serving on the new Condominium Dispute Resolution Tribunal as part-time Tribunal Members to serve as adjudicators and/or mediators to resolve disputes about condominium matters.

Location
The Condominium Dispute Resolution Tribunal is located in Edmonton, Alberta. Applicants are not required to live in Edmonton, as duties can generally be completed virtually.
About the Agency

The Condominium Dispute Resolution Tribunal is an independent, impartial, quasi-judicial tribunal that provides timely alternative dispute resolution services to parties involved in condominium related disputes. The Condominium Dispute Resolution Tribunal seeks to resolve disputes by providing supports and services to disputing parties including guided negotiation, mediation and, if unable to be resolved, adjudication of the dispute.

The Condominium Dispute Resolution Tribunal is a new Tribunal established under the Condominium Property Act and whose Members will be appointed by the Minister of Service Alberta and Red Tape Reduction.

Role Description

Members will serve as mediators and/or adjudicators to resolve disputes between condominium owners and boards. As a mediator, you will lead formal mediation sessions between parties. You will use your superior dispute resolution, facilitation, and communication skills, while acting in a neutral manner with the goal of assisting parties in coming to a resolution in their matter. You will also draft mediated agreements for circulation to the parties.

As an adjudicator, you will participate as a panel member responsible for conducting adjudication hearings to:

  • review evidence presented by the parties;
  • weigh and address evidence and submissions; and
  • prepare written decisions within the legislative framework.

Adjudication panels will consist of one to three members, depending on the complexity of the dispute being adjudicated. You will use your strong analytical, problem-solving, and communication skills to make and write decisions that are fair and reasonable, while observing the principles of natural justice and administrative law.

Successful candidates may be asked to perform the role of both a mediator and an adjudicator, but will never perform both roles for the same dispute.

Candidates must be Alberta residents and may not be current elected municipal officials or members of organizations with mandates that may conflict with the Condominium Dispute Resolution Tribunal’s mandate and jurisdiction.

Skills and Experience Required
  • Education, certification, and experience in alternative dispute resolution, including mediation and/or adjudication.
  • Experience in preparing for and leading hearings and discussions including assessing submissions, arguments, and other evidence presented in a proceeding to inform decisions and preparing written decisions based on evidence and facts.
  • Experience with condominium law would be an asset.
  • Financial acumen including experience with organization-wide finances that may include budgeting, planning, and reporting.
  • Transparency and integrity in personal, business, and professional dealings.
  • Proven analytical and problem-solving skills with a strong reputation for fairness.
  • Exceptional time-management and organizational skills, and experience with conducting virtual and in-person meetings.
  • Strong written and oral communication skills.
  • Strong decision-facilitation and dispute-resolution skills.
  • Solid computer skills including word processing and internet tools.

Specialized Knowledge and Experience

  • Experience with a quasi-judicial agency, board, or committee environment, including preparing for and conducting hearings and adjudicating cases based on relevant facts and administrative law principles and natural justice. This includes:
    • the interpretation and application of legislation;
    • relevant case law and the principles of fairness;
    • reviewing and evaluating submissions, arguments, and evidence; and
    • preparing written decisions based on the review and evaluation of that evidence.
  • Knowledge of the condominium sector in Alberta, including knowledge of condominium governance, property managers and property management, property development, or other condominium related knowledge areas is preferred.
Remuneration and Time Commitment

Appointment terms are up to three years with the possibility of reappointment for additional terms of up to three years, to a maximum of 12 consecutive years. As this Tribunal is a new service, an accurate estimated time commitment cannot be provided, though it is likely that 5 to 10 days per month may be required. The amount of time will depend on the volume of applications.

Mediation meetings and adjudication hearings may take place across different platforms, including video conference, teleconference, in writing, and in person. General Tribunal meetings and training sessions will also take place across different platforms, including video conference or in person.

Remuneration is paid as a per diem based on Schedule 1, Part A of the Committee Remuneration Order:

Remuneration paid to Tribunal members will be based on the activities performed at the Tribunal, as follows:

Members other than the Chairman:

  • a. $164 for up to and including four hours in any day; or
  • b. $290 for over four hours and up to and including eight hours in any day; or
  • c. $427 for over eight hours in any day, spent on the business of the committee;

Chairman or person acting as the chairman:

  • a. $219 for up to and including four hours in any day, or
  • b. $383 for over four hours and up to and including eight hours in any day, or
  • c. $601 for over eight hours in any day, spent on the business of the committee.

Expenses are paid in accordance with the Travel, Meal, and Hospitality Expenses Policy.
