The Minister of Agriculture and Irrigation is seeking applications from individuals interested in serving as a member of the Marketing of Agricultural Products Act Appeal Tribunal (Appeal Tribunal).
- Three members are required to fill upcoming vacancies.
The function of the Appeal Tribunal is to hear, in a fair and impartial fashion, appeals of orders, directions
or decisions made by the 19 agricultural marketing boards and commissions regulated by the Marketing of Agricultural Products Act. Appeal Tribunal members may also be considered on a list of nominees
submitted to the Minister for appointment to hear appeals under other department’s legislation.
Members are appointed for three-year terms by Ministerial Order. Members seeking reappointment may serve for a maximum of two consecutive terms, at the Minister’s discretion.
Members are responsible for conducting hearings as a member of a three-person panel. Members will review the decisions of regulatory bodies under appeal, review evidence and arguments, ask questions where appropriate, and collaborate to reach a decision as authorized by their governing statute and regulation.
Members will prepare written reasons for decisions and issue them to the parties to an appeal. Members will abide by the Code of Conduct, Mandate and Roles Document of the agency, and governing legislation, and will conduct themselves in an impartial manner so as to avoid any possible apprehension of bias.
Applicants must have demonstrated evidence of strong analytical, communication and interpersonal skills.
Candidates should have experience or in-depth knowledge of Alberta’s agricultural production and marketing, supply managed agricultural sectors and an awareness of the issues affecting Alberta’s agricultural industry. Knowledge of the Marketing of Agricultural Products Act and related regulations would be considered an asset.
Presiding skills and an understanding of administrative justice would be an asset. The Appeal Tribunal is supported by private sector legal counsel and a staff member from the Alberta Agricultural Products Marketing Council who will serve as the administrator to the Appeal Tribunal. Experience working in a legal setting would also be considered an asset.
Interested candidates should have experience in the agricultural, supply managed, or processing sectors and in-depth knowledge of related industry and governance issues. Well-developed communication and interpersonal skills complemented by relevant experience working with industry organizations, related stakeholders and governments will ensure success in the role.
Appeal Tribunal members are paid an honorarium and travel expenses as prescribed by the Lieutenant Governor in Council in OC466/2007, the Committee Remuneration Order, Schedule 1 Part A (effective April 1, 2009).
A member shall be paid:
$164 for up to and including four hours in any day,
$290 for over four hours and up to and including eight hours in any day, or
$427 for over eight hours in any day spent on committee business
Appeal Tribunal members are only remunerated for the time they spend hearing appeals and/or performing related duties such as travelling to hearings or taking required training.
Appeal Tribunal members are required to attend training and sit at hearings that are typically held in the greater Edmonton area, although members may be required to sit outside of Edmonton or virtually. Members will be provided training as needed to prepare for any appeals they are to hear. Panels typically hear one to two appeals per year
