Role Required

The Minister of Education and Childcare is seeking applications from qualified individuals interested in serving as members on the Certification Appeal Committee (CAC).

Location
Appeal hearings and meetings are typically held virtually but can also be held in-person in Edmonton when required.
About the Agency

The CAC, established under Alberta’s Certification of Teachers and Teacher Leaders Regulation 123/2022, hears appeals from individuals who have been denied issuance, re-issuance, or extension to a teaching, leadership, or superintendent leadership certificate by the Registrar.

An appeal to the CAC may result in a hearing in which the CAC may make a final decision to uphold, overrule or vary, with or without conditions, decision, or recommendation of the Registrar.

CAC members have responsibilities under, and are subject to, several statutes and regulations including the:

Role Description

Members of the CAC are teachers or teacher leaders and public members who are respected individuals in the community and demonstrate credibility, accountability, integrity, respect, transparency, and excellence in their profession. They have extensive experience and expertise in conducting administrative hearings in relation to appeals from individuals.

Members of the CAC incorporate tenets of due process and natural justice in their practice when adjudicating appeals.

Appointments to the CAC are made by ministerial order for terms of up to three years, with opportunity for reappointment. A member may be reappointed for additional terms up to a maximum of 12 years in accordance with the Alberta Public Agencies Governance Act.

Skills and Experience Required

The candidate must demonstrate competence, credibility, accountability, ethics, integrity, respect, transparency, and excellence.

The candidate must apply tenets of natural justice such as:

  • be impartial and free from improper influence and interference;
  • demonstrate fairness in process and decision-making; and,
  • act in a manner which avoids any conflicts of interest.

The candidate must demonstrate excellent English language skills, oral and written.

  • Required skills, abilities, and experience include:
  • experience with interpreting and applying legislation;
  • experience in conducting hearings, conflict resolution, and/or mediation processes;
  • recent experience serving on a private, public and/or volunteer/non-profit board or committee (e.g. a professional, school, or community organization) with knowledge of how a board or committee functions;
  • knowledge of or experience participating in administrative proceedings such as disciplinary hearings or tribunals and, using tenets of natural justice;
  • strong leadership skills, with the ability to lead appeal proceedings in accordance with legislation;
  • strong interpersonal skills, with the ability to recognize and value the contributions of parties to an appeal; and,
  • ability to apply critical thinking and problem-solving skills to make decisions in accordance with legislation.

The following are considered an asset:

  • Experience in conducting appeals and making orders in accordance with legislated processes.
  • Knowledge of provincial K-12 education system and related legislation.
  • Ability to apply critical-thinking and problem-solving skills to assess situations and to generate solutions.
  • Oral and written fluency in French is considered a significant asset.

Remuneration and Time Commitment

Remuneration is provided in accordance with the rates specified in Schedule 1, Part B of the Committee Remuneration Order (OC 466/2007), as determined by the department:

  • $115 for up to and including four hours in any day;
  • $191 for over 4 hours and up to and including eight hours in any day; or
  • $306 for over eight hours in any day.

Members may be reimbursed for reasonable expenses necessarily incurred while performing their duties, in accordance with the Travel, Meal and Hospitality Expenses Policy. In addiction, school districts may apply to the Minister for reimbursement of costs incurred to employ a substitute teacher on behalf of a member who is unable to teach during instances of carrying out committee work.

Appointed members are required to comply with the Public Sector Compensation Transparency Act, by disclosing remuneration gained from being a member of the CAC.

Time commitment for members is determined by the volume of appeals filed with the CAC and the complexity of appeal hearings and adjudications.
