Role Required

The Ministry of Service Alberta and Red Tape Reduction (SARTR) is seeking applications from individuals interested in future participation on the SARTR Consumer Services Appeal Boards. Appointments to a specific appeal board are determined on an ad hoc basis with individuals selected from a pre-certified roster that this recruitment will aim to fill.

This recruitment will fill three Chairpersons and three Panel Members.

About the Agency

Under the Consumer Protection Act, Cemeteries Act, and Funeral Services Act, a licensing decision or enforcement action (such as a Director’s order or administrative penalty) can be appealed by a business/person by serving the Minister with a written notice of appeal within 30 days of being notified of the decision.

In accordance with the legislation, the Minister has 30 days to appoint an appeal board upon receipt of a notice of appeal. To meet this timeline, Chairpersons and panel members are pre-certified through a formal recruitment process, and then placed on a list for consideration of appointment to an appeal panel.

Role Description

A chairperson will provide the overall leadership to Appeal Boards, which includes:

  • serve as the chair for the appeal board;
  • timely and effective managing of the appeal board;
  • communicating with the appellant, respondent, and other appeal board members;
  • dealing with procedural matters and preliminary applications, scheduling hearings, and resolving conflicts; and
  • preparing a written decision.

A panel member is responsible for:

  • assessing evidence and participating in decision-making in a quasi-judicial proceeding;
  • preparing for and actively participating in hearings and discussions;
  • staying informed about appeal board matters; and
  • reviewing and commenting on hearing documents.

Successful members remain on the pre-certified list for terms of up-to-five years. Terms are staggered to allow for renewal and continuity of the pre-certified roster.

Skills and Experience Required

The applicant demonstrates:

  • experience in quasi-judicial proceedings, including strong knowledge of the principles of administrative law and natural justice in the private, public, and/or volunteer/non-profit sector.
  • governance experience acquired through prior board or committee service.
  • the ability to listen to and assess appellants’ and respondents’ submissions, and the ability to communicate with appellants of diverse backgrounds and education levels to support the gathering, understanding, and explaining of relevant details.
  • excellent listening, oral communication and writing skills. • consistently acting in the highest ethical manner, with a commitment to accountability.
  • transparency and integrity in all personal, business, and professional dealings.
  • exceptional time management and organizational skills • experience with arranging and conducting virtual meetings.
  • experience with Microsoft 365 applications, including Teams, Word and Excel.
  • ability to work toward set timelines and deliverables.
Remuneration and Time Commitment

When appointed to an Appeal Board, members will be compensated for their time preparing for, attending and concluding hearings, as well as travel expenses to attend hearings. Compensation is currently set by Appendix 3, Schedule 1, Part A of the Committee Remuneration Order (O.C. 466/2007) and the ministry Appeal Board Remuneration policy. Honoraria rates are subject to review.

Current Chairperson Honorarium details are as follows:

$219 for up to and including four hours in any day;
$383 for over four hours and up to and including eight hours in any day; or
$601 for over eight hours in any day
spent on the business of the committee.

Current Panel Member honorarium details are as follows:

$164 for up to and including four hours in any day;
$290 for over four hours and up to and including eight hours in any day; or
$427 for over eight hours in any day
spent on the business of the committee.

If pre-certified, appeal chairpersons and panel members could be contacted one to three times per year on average. The time commitment ranges from one to three days per hearing, in addition to administrative tasks involving preparation for the hearing.

To be eligible, applicants must be a resident of Alberta, cannot be the director, a licensee, or an employee of SARTR, nor an employee of the regulator in which the director is employed.

The applicant must not have or derive any direct or indirect interest from an industry regulated under the Consumer Protection Act, Cemeteries Act, Condominium Property Act, or Funeral Services Act.

Service Alberta and Red Tape Reduction welcomes candidates representing varied backgrounds, careers, and community leadership experience. If successful, orientation will be made available to support participation.

Final candidates may be asked to undergo background and reference checks.

Final candidates will be required to provide education credentials. It is recommended that applicants with educational credentials from outside of Canada obtain an evaluation of their credentials from the International Qualifications Assessment Service (IQAS) if they have not done so already. It is recommended that applicants include the assessment certificate from IQAS or any other educational assessment service as part of their application.
