The Minister of Justice is seeking applications from individuals interested in serving as a psychiatrist member or as a legal member of the Criminal Code Review Board.
The Criminal Code Review Board is an independent adjudicative tribunal established under the Criminal Code of Canada to make and review dispositions concerning any accused person for whom a verdict of “not criminally responsible because of mental disorder” or “unfit to stand trial” is rendered. The Board is also responsible for determining whether a person should be subject to a detention order or a conditional discharge and the terms or conditions to be imposed, or whether that person should be granted an absolute discharge.
The Board holds hearing and exercises the authorities and obligations of a court with a mandate to balance the safety of the public and the reintegration of the accused into society. Membership is comprised of psychiatrists, lawyers and public representatives.
As a member of the Board, you will contribute to fair and expeditious hearing conducted in accordance with the requirements of the Criminal Code and principles of natural justice. Along with your panel co-members, you will consider oral and written evidence and submissions, assess the credibility of expert and lay witnesses, and apply statute and common law to the facts and merits of cases before you.
Ideally your background includes considerable experience in roles demanding the application of fair, transparent, consistent, and principled decision making with strengths in analyzing complex information and varying points of view. As a skilled communicator, you are recognized for a reputation of consistently applying impartiality, objectiveness, and sound judgment in managing challenging and sensitive issue. Prior experience with administrative proceedings, hearing processes, or adjudication is an asset. Sensitivity to factors including cultural diversity, and an understanding of the Criminal Code of Canada, mental health law, and the provincial mental health system will support success as a panel member.
- Psychiatrist candidates must be eligible for a license to practice in Alberta and have a good standing with the Alberta College of Physicians and Surgeons. Knowledge of forensic psychiatric practices, or risk assessments is an asset.
- Legal members are required to have a Bachelor of Laws (LLB), and be an active member in good standing with the Law Society of Alberta for at least ten years.
The recruitment process recognizes the importance of reflecting the diversity of Alberta and welcomes candidates presenting varied backgrounds and career experience. To ensure balanced representation on the Board, this recruitment is seeking backgrounds in law or psychiatry.
Final candidates will be asked to undergo a comprehensive background check, disclosure, and conflict of interest screening.
- The Criminal Code Review Board members are remunerated by honorarium for their time spent attending board hearings. Travel expenses are reimbursed in accordance with the Government of Alberta’s Travel, Meal and Hospitality Expenses Directive.
Order in Council 003/2020 establishes the following rates of remuneration payable to members:
For the chairperson, alternate chairperson and lawyers:
- $432 for up to and including four hours in any day, or
- $888 for over four hours and up to and including eight hours in any day,
- and $111 per hour after eight hours to a maximum of 12 hours in any day;
For psychiatrists shall be paid:
- $790 for up to and including four hours in any day,
- $197 for each additional hour or part of an hour
Hearings for the Criminal Code Review Board are scheduled predominantly by videoconference.
