Are you a socially conscious person with an interest in helping Alberta’s regulated health professions govern their members in a manner that protects and serves the public interest? Are you looking for a new and exciting opportunity to support the complaint and disciplinary responsibilities of the various college councils and associations that govern Alberta’s regulated health professions?

The Minister of Health is seeking applications from individuals interested in serving in the Roster of Public Members (Tribunal Roster) under the Health Professions Act.

Location
Public members can be located throughout Alberta. Meetings of complaint review committees and hearing tribunals are held primarily in Edmonton and Calgary.
About the Agency

The Tribunal Roster, established under section 13(1)(b) of the Health Professions Act (HPA), is a list of public members appointed by the Lieutenant Governor in Council that is used by health profession regulatory colleges (governed under the HPA) to select public members for complaint review committees or hearing tribunals.

There are 28 regulated health professions under the Act that require public members to sit on their hearing tribunals and complaint review committees.

Role Description

This is an excellent opportunity for Albertans looking to raise their professional and personal profile by working alongside regulated health professionals to uphold accountability and competency standards within their specific professions. By providing an external perspective, public members support health regulatory colleges in governing their profession that protects and serves public interest.

As a public member on the Tribunal Roster you will be required to:

  • review and hear written and oral evidence presented to the complaint review committee or hearing tribunal with respect to complaints made against regulated health professionals;
  • in accordance with the HPA, analyze, assess and weigh the evidence presented against the regulated professions’ codes of ethics, standards of practice and regulations to reach a fair and impartial decision; and
  • participate in the development of, and review, the written decision following the close of disciplinary proceedings.

Public members are appointed for a term of up to three-years and may be eligible for reappointment for an additional term but may only serve a maximum of six consecutive years.

Skills and Experience Required

Public members appointed to the Tribunal Roster should possess the following skills:

  • Effective communication skills;
  • Analytical/critical thinking/problem solving skills;
  • Leadership/collaboration skills;
  • Ability to synthesize information;
  • Health sector knowledge;
  • Regulatory and professional governance knowledge; and
  • Ability to exercise objectivity, sound judgement and diligence.

Ideally, public members appointed to the Tribunal Roster should also possess more than one of the following:

  • Basic knowledge of Alberta’s health care system and Alberta’s regulated health professions
  • Knowledge and/or experience in:
    • Quasi-judicial proceedings;
    • Administrative justice;
    • Decision making; and
    • Interpreting and applying legislation.

Remuneration and Time Commitment

Public members are appointed for a term of up to three-years and may be eligible for reappointment for an additional term but may only serve a maximum of six consecutive years.

  • This is not a wage or salaried position.
  • Public members appointed to the Tribunal Roster receive remuneration in accordance with Schedule 1, Part B of the Committee Remuneration Order (O.C. 466/2007), subject to review. The current rates that a public member may claim for attending meetings and hearings are:
    • $115 for up to and including four hours in any day, or
    • $191 for over four hours and up to and including eight hours in any day, or
    • $306 for over eight hours in any day, spent on the business of the complaint review committee and/or hearing tribunal.
    • They may also be reimbursed for reasonable living and traveling expenses necessarily incurred in the course of performing their duties as public members in accordance with the Public Service Relocation and Employment Expenses Regulation Government of Alberta’s Travel, Meal and Hospitality Expenses Policy.
  • Time commitment is variable and subject to the volume of college complaint committees and hearings.
  • The length of hearings vary from part of a day to several consecutive days; however review committees and hearing tribunals may also meet in advance of the main proceeding.
  • These proceedings often require significant preparation time, which is not currently eligible for remuneration.
  • Complaint review committees and hearings maybe held in locations across Alberta; however, are primarily held in Edmonton and Calgary, or virtually.

The following person is NOT be considered for appointment as a public member:

  • a person who is a regulated member of that specific health professions regulatory college;
  • a person who represents or is normally engaged in representing a group of employees who are regulated members in the negotiation of collective bargaining agreements or in any proceedings under a collective bargaining agreement with respect to regulated members or who negotiates or sets professional fees or guidelines on professional fees on or on behalf of regulated members of the college;
  • a person who is an officer or senior employee of a professional association or a labour union that represents members of a regulated health profession; and
  • a member or office of a regional health authority;
  • individuals whose appointment would result in an actual or perceived conflict of interest that cannot be managed; or
  • an employee of Alberta Health.
