The Minister of Energy is seeking applications from individuals interested in serving as the Administrator (Chief Executive Officer) for the Market Surveillance Administrator Corporation (MSA).
The Market Surveillance Administrator Corporation (MSA) is an independent enforcement agency that protects and promotes the fair, efficient, and openly competitive operation of Alberta’s wholesale electricity markets and its retail electricity and natural gas markets. The MSA also works to ensure that market participants comply with the Alberta Reliability Standards and the Independent System Operator’s rules, and that they operate in a fair, efficient and openly competitive manner.
The mandate of the Market Surveillance Administrator is set out in the Alberta Utilities Commission Act (AUCA) and related regulations, including the Alberta Market Surveillance Regulation. Further relevant legislation and authorities include:
• Electric Utilities Act (and regulations under that Act, including the Alberta Electricity Code of Conduct Regulation)
• Gas Utilities Act (and regulations under that Act)
• Independent System Operator (ISO) rules
• Decisions, orders or rules of the Alberta Utilities Commission
• Market Surveillance Administrator Corporation bylaws

The business and affairs of the Market Surveillance Administrator Corporation are overseen by an individual appointed as Market Surveillance Administrator (the Administrator) by the Minister of Energy. This leader is supported by a MSA team in discharging its mandate to assess and, where necessary, take action to promote effective competition in Alberta’s electricity and retail natural gas markets.
Prior to June 1, 2003, the market surveillance administrator function was carried out under the Power Pool Council. In 2003, the Market Surveillance Administrator was incorporated as an independent, standalone entity under the Electric Utilities Act of the Province of Alberta. Clarification of the role and mandate of the Market Surveillance Administrator was further provided in the Alberta Utilities Commission Act (AUCA), which was proclaimed on January 1, 2008.
Within the context of Alberta's competitive market structure, the Administrator plays a critical role in influencing the electricity and retail natural gas markets. Their expertise in energy economics will be essential to oversee market performance and establish conditions for fair, efficient and openly competitive outcomes. They lead a team of professionals delivering balanced and effective surveillance, investigation and enforcement processes. The capacity to assess highly complex technical issues, and build and maintain relationships with diverse business, government, and industry stakeholders will be key to success in this role.
• A university degree in a related discipline is required, preferably economics, engineering, business or law.
• Senior leadership experience in the energy or utility sector with expertise in electricity and natural gas markets.
• Understanding of Alberta’s regulatory system, the interaction of different jurisdictions, the principles of natural justice and the operation of quasi-judicial boards and hearings.
• Knowledge of energy economic theory, competition and anti-competitive behavior.
• Demonstrated ability to build and maintain effective relationships with diverse stakeholders in a dynamic environment.
• Strong interpersonal, collaborative and mediation abilities with well-developed verbal and written communication skills.
• Demonstrated analytical skills with the ability to take complex information and diverse points of view into consideration in making sound decisions.
• Proven track record of sound and consistent judgment with an ability to understand the implications of market intervention and gauge action accordingly.
• Strong leadership and coaching skills to lead a group of professionals within a team environment.
The MSA is subject to the Alberta Public Agencies Governance Act.
The remuneration for this position is established in accordance with the Compensation Regulation for Public Agencies, Boards and Commissions. The annual salary range for this position is $153,595 - $207,805, dependent on qualifications.
The Administrator role for the MSA is a full-time role, and is appointed for a term not to exceed five years. The Administrator may be reappointed for one or more terms not more than five years each. Pursuant to the APAGA, the Administrator may not serve for more than 10 consecutive years.
